However, product photographs and graphics are not contractual and may present slight color or appearance variations depending on screen display settings.

  • Original artworks: Each original work is unique and handmade. Some may be accompanied by a certificate of authenticity attesting to their uniqueness.

  • Limited editions: Some art prints are issued in limited series, numbered and signed. Once the edition is sold out, no new copies will be produced.

  • Merchandise: Other creations, such as open edition prints, stationery, or accessories inspired by our artworks, are also available.

Products are available for purchase while supplies last and may be shipped to the destinations offered during the order process.

7. Intended Use and Recipients of the Products

The following professional uses are authorized, for example:

However, any form of resale—direct or indirect—of purchased products is strictly prohibited. This includes, in particular:

  • purchases made by resellers or intermediaries acting on their behalf;

8. Tariffs

11. Retention of Title

SARL Endless Summer retains full ownership of the products sold until full payment of the price, including taxes and fees. In case of non-payment, SARL Endless Summer reserves the right to recover the products, without prejudice to any legal action.

12. Right of Withdrawal

12.1 Right of withdrawal on original artworks

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to original artworks, including paintings, sculptures, and other unique creations sold on the site laurinemirenka.com. These works being unique and non-standardized products, they cannot be returned or exchanged, unless the product is non-compliant or visibly defective upon receipt of the artwork.

12.2 Right of withdrawal on prints and merchandise

The right of withdrawal only applies to products such as prints and merchandise offered on the site. The buyer has a period of fourteen (14) days from the receipt of their order to exercise their right of withdrawal, without the need to justify their decision.

12.3 How to exercise the right of withdrawal

The buyer wishing to exercise their right of withdrawal must inform the company of their decision by sending a clear statement via email to the following address: laurinemirenka@gmail.com, or by filling out the contact form available on the site.

The products must be returned in their original condition and in their original packaging. The consumer must return or hand over the goods to the professional or to a person designated by them, without excessive delay and at the latest within fourteen days following the communication of their decision to withdraw, in accordance with Article L. 221-21 of the Consumer Code. Return shipping costs will be the responsibility of the buyer.

12.4 Products excluded from the right of withdrawal

Under current legislation, original artworks, once delivered, cannot be returned due to their unique and personalized nature.

12.5 Refund and delivery costs

If the right of withdrawal is exercised on an eligible product (prints, merchandise), the refund will be made within 14 days following the receipt of the returned products. Provided that they are returned in perfect condition, unused, and in their original packaging. Any damaged, incomplete, or used product cannot be refunded. However, the initial delivery fees will not be refunded. Only the price of the returned products will be refunded.

Please note that there are certain legal exceptions to the right of withdrawal, and some items may not be returned or exchanged. We will inform you if this applies to your particular case.

13. Delivery

13.1 Geographic Area and Carrier

Deliveries are made only to the geographic areas indicated on the site laurinemirenka.com and to the address provided by the buyer when placing the order. The company SARL Endless Summer primarily uses the services of La Poste, DHL, UPS, and Mondial Relay for product delivery. If the buyer chooses tracked delivery, a tracking number will be provided to allow real-time tracking of the order.

13.2 Delivery Times

Delivery times are indicated on each product page, as they may vary depending on the availability of each artwork or product, particularly drying and varnishing time for original works. Due to logistical constraints, delays may occur, especially if an artwork becomes popular on social media. We apologize in advance for any delays and thank the buyer for their patience. If the buyer wishes to modify their delivery address after placing the order, they must inform us within 24 hours to ensure the modification of the order. No address change can be made once the order has been shipped.

13.3 Verification upon Receipt

The buyer is responsible for checking the condition of the packaging and products at the time of delivery, in the presence of the delivery person. Upon acceptance of the package, it is considered received in perfect condition. No claims will be accepted by SARL Endless Summer if the buyer has not made reservations with the delivery person. In case of damage, anomaly, or non-compliance, the buyer must immediately report the situation to the carrier and SARL Endless Summer, within three (3) days of receiving the package. Any claim made after this period cannot be accepted.

13.4 Non-compliance of Products

In the event of a product being delivered that does not comply with the order (wrong model, size, or reference), the buyer has a period of 15 days from receipt to report the issue to SARL Endless Summer. After validation of the claim, an exchange or refund may be offered, subject to product availability.

13.5 Responsibility in case of delay or force majeure

Delivery delays will not entitle the buyer to cancel the order, refuse the goods, or demand damages. SARL Endless Summer cannot be held responsible for delays or cancellation of delivery due to force majeure, such as strikes, postal service disruptions, extreme weather conditions, or other events beyond our control.

13.6 Transport Risks

The risks associated with the transport of products are the responsibility of the buyer as soon as the products leave the premises of SARL Endless Summer. Once the package is accepted, the buyer is deemed to have received the products in perfect condition. In case of a problem, the buyer must inform the carrier and SARL Endless Summer within the specified deadlines.

13.7 Errors in Order Information

The buyer is responsible for the accuracy of the information provided during the order, particularly the delivery address. In case of errors in the information, SARL Endless Summer cannot be held responsible for the inability to deliver the order correctly. If the buyer requests a refund or reshipment of the product in this case, the initial delivery fees and return fees will be at the buyer's expense.

14. Warranty

All products supplied by SARL Endless Summer are covered by the legal warranty provided by articles 1641 and following of the French Civil Code. In case of non-conformity of a product sold, it may be returned to SARL Endless Summer, which will accept it back, exchange it, or refund it. 14.1 Legal Warranty of Conformity

SARL Endless Summer will not cover any shipping costs and cannot be held responsible in case the package is not received.

  • Return Timeframe: Claims, exchange or refund requests must be made within thirty (30) days after delivery. Returned products must be in their original condition, without any modification or damage.

14.3 Limitations of the Warranty

The products sold by SARL Endless Summer, whether original works of art, art prints, or derivative products (stickers, plush toys, clothing, etc.), may be subject to different warranties.

  • Original Works are not covered by the legal warranty of conformity, but are covered by the warranty for hidden defects.

  • Art Prints and Derivative Products are subject to the legal warranty of conformity and may be exchanged or refunded in case of evident non-compliance.

The legal warranty does not cover the following situations:

  • Normal Wear: Natural degradation of products over time, such as the fading of colors or texture of artwork, is not covered by the warranty.

  • Improper Handling or Storage: Damage resulting from improper use or handling of the product by the buyer, or inappropriate storage (such as exposure to humidity, excessive heat, or direct sunlight), will not be covered by the warranty.

  • Accidental Damage: The warranty does not cover damages caused by accidents, such as falls, impacts, or intentional damage.

It is the buyer's responsibility to take care of the artwork and display it in appropriate conditions to preserve its quality and integrity. Any damage caused by improper handling or unsuitable environmental conditions will not be eligible for a refund or exchange.

15. Liability

SARL Endless Summer is bound to an obligation of means regarding distance selling. It cannot be held responsible for damages resulting from the use of the site, improper use of the products sold, or failures related to the Internet network.

The company assumes responsibility for the products delivered, in accordance with the applicable legal warranties, including the legal warranty of conformity and the warranty against hidden defects.

The liability of SARL Endless Summer cannot be engaged for any indirect damage or for any damage exceeding the total amount of the order, limited to 1,500 euros.

16. Intellectual Property

The purchase of a work does not allow the client to reproduce the work in the form of an NFT, print it for resale, reproduce it on commercial media, or exploit it in any form without the prior consent of the artist. Any unauthorized use may lead to legal action.

Clients are permitted to share images of the work on social media, provided they clearly mention the artist and do not alter the image of the work. This permission does not extend to reproductions or commercial uses of the work, which require explicit authorization from the artist.

17. Third-Party Ownership
